Terms and Conditions

These Terms & Conditions apply to all individuals staying at or utilising the Legacy WA Busselton Camp facilities.

Legacy WA is committed to providing a safe, respectful, inclusive, and professionally managed environment in accordance with the Work Health and Safety Act 2020 (WA) and associated Regulations.

These Terms & Conditions are established to:

  • Protect the safety and wellbeing of guests, staff, and volunteers.
  • Clarify guest responsibilities during their stay.
  • Manage operational and safety risks.
  • Preserve the facilities and environment for future users.
  • Ensure compliance with applicable legislation and community standards.

By making a booking and/or entering the Camp premises, guests acknowledge that they have read, understood, and agreed to comply with these Terms & Conditions. Continued occupancy constitutes acceptance of these conditions.

Legacy WA's Client Rights and Responsibilities also apply to this agreement.

 

1. Eligibility

Use of the Busselton Camp is restricted to individuals, their partner/spouse and/or dependents, and groups within the following categories:

  • Legacy Beneficiaries (Legacy WA and Interstate Legacy Clubs)
  • Legacy WA Legatees
  • Legacy WA Staff
  • Current and Former Australian Defence Force members (including Reservists)
  • Emergency Services Personnel (including WA Police, DFES and St John Ambulance)

Proof of service or eligibility must be provided at the time of booking and may be requested at check-in.

Any bookings outside this eligibility require approval from Legacy WA management and must requested in writing to getsupport@legacywa.com.au. Legacy WA reserves the right to approve, decline or cancel bookings where the intended use is not aligned with organisational objectives.

2. Accommodation & Payment

  • Full payment (100%) of the booking value is required at the time of reservation unless otherwise agreed to in writing by Legacy WA.
  • Flat rates apply to all accommodation types, regardless of the number of guests occupying the accommodation.
  • A booking is not confirmed until payment has been successfully processed.
  • A confirmation will be issued via email.
  • Reception hours are 1:00pm – 4:00pm.
  • Check-in is from 2:00pm on the day of arrival.
  • Check-out must be no later than 10:00am on the day of departure.
  • Guests arriving outside reception hours must contact the Camp Caretaker on 08 9755 4530 during reception hours to arrange safe key collection.
  • Failure to arrive on the scheduled arrival date without prior notice will result in forfeiture of the first night’s accommodation.
  • A credit card in the name of the guest staying must be presented at check-in. Legacy WA reserves the right to recover costs for damage, loss, excessive cleaning, or breaches of Camp Rules.

3. Legacy WA Beneficiary Accomodation Entitlement

Legacy WA Beneficiaries are permitted access to one (1) complimentary stay at the Busselton Camp per calendar year, and must be an enrolled beneficiary of the following categories:

  • Widow or Widower of a Veteran.
  • Partner/Spouse of an Ill-health Veteran.
  • Child/ren who were a dependent of a deceased Veteran.
  • Child/ren who are a dependent of an Ill-health Veteran.
  • Adult child of a Veteran enrolled as a beneficiary living with a recognised disability.

Dependent child/ren are recognised as those under the age of 18, or under the age of 25 where they remain dependedent on the family unit.

Complimentary stays are subject to the following conditions:

  • All guests meet the eligiblity criteria.
  • Are subject to availability.
  • May not exceed seven (7) nights.
  • Do not roll over to the following calendar year if unused.
  • A Veteran will not be charged accommodation fees when staying with their partner/spouse and/or children, provided they are eligible Legacy WA beneficiaries.
  • Additional guests that do not meet eligibilty and occupy the same room will be charged $40.00 per person, per night, and must stay for the same duration as the eligible beneficiary
  • Additional guests that do not meet eligibilty and occupy a seperate room will be charged the full rate, and must stay for the same duration as the eligible beneficiary.

4. Minimum Stay Requirements

  • Two (2) night minimum stay applies to all weekends.
  • Three (3) night minimum stay applies to all long weekends.
  • Four (4) night minimum stay applies over Easter.

5. Cancellation Policy

Booking cancellations will be refunded as follows:

  • More than 40 days - Full refund.
  • Less than 40 days – 75% refund.
  • Less than 30 days – 50% refund.
  • Less than 14 days – 20% refund.
  • Less than 7 days – No refund.

Refunds will not be provided for:

  • No-shows.
  • Late arrivals.
  • Early departures.
  • Adverse weather conditions.

Any refund owing will be paid to the original method of payment.

Requests for consideration of extraordinary circumstances require approval from Legacy WA management and must be submitted in writing to getsupport@legacywa.com.au.

6. Reservation Changes

  • A $100 administration fee applies for cancellations made outside 45 days of arrival and for booking modifications.
  • Complex changes involving multiple rooms and/or dates will incur additional fees.
  • Any increase in booking value must be paid at the time the change is confirmed.
  • Any refund owing will be paid to the original method of payment.

7. Right to Refuse or Cancel Bookings

Legacy WA reserves the right, at its sole discretion, to refuse or cancel any booking where booking information is inaccurate, payment obligations cannot be met, safety risks are present, or previous Camp Rules have been breached.

8. Work Health & Safety (WHS) Responsibilities

  • Guests must take reasonable care for their own health and safety.
  • Guests must ensure their behaviour does not adversely affect others.
  • Guests must comply with reasonable safety instructions issued by management.
  • Guests must report hazards or unsafe conditions immediately.
  • Guests are fully responsible for the supervision and conduct of any children staying with them, including property damage or misconduct.

9. Behaviour and Conduct

  • Unacceptable behaviour includes, but is not limited to, aggressive or abusive conduct, harassment, excessive intoxication, illegal drug use, vandalism, unsafe use of facilities, supplying alcohol to minors, refusal to comply with reasonable directions, or any behaviour that disrupts other guests.
  • Legacy WA reserves the right, at its discretion, to require any guest or visitor to immediately leave the Camp where their behaviour breaches Camp Rules, creates a safety risk, causes damage, or is considered inappropriate or socially unacceptable.
  • Where removal occurs, no refund will be provided, and the guest remains responsible for any loss, damage or associated costs.

10. Alcohol

  • Alcohol consumption must be lawful, moderate, and responsible.
  • Guests must prevent intoxication-related risks and ensure minors do not access alcohol.
  • Legacy WA reserves the right to remove guests where alcohol use creates safety concerns or nuisance.

11. Site Rules and Safety Requirements

  • The Camp is strictly smoke-free.
  • Vehicles must not exceed 8km/h and must park in designated areas.
  • Children must be supervised at all times.
  • Rooms and facilities must be left clean and tidy upon check-out. Bins and vaccuums are available at multiple points around the premises.
  • Visitors may attend while the booking guest is present but may not stay overnight.
  • Noise must be kept to a minimum between 9:00pm and 7:00am.
  • Firewood must be used safely and only when no fire bans are in place.
  • Doors to communal areas are to be kept closed at all times.

12. Pet Policy

  • Pets are not permitted except certified assistance dogs.
  • Certification must be provided at booking and presented on arrival.
  • Handlers are responsible for control, hygiene and ensure the animal does not create safety risks.

13. Caravans, Tents and Temporary Structures

The erection or placement of caravans, tents, swags, gazebos, annexes or any temporary structures on Campgrounds is not permitted without prior written approval from Legacy WA.

Where approval is granted:

  • An accommodation fee equivalent to a room booking will apply.
  • Placement must be in the designated area approved by management.
  • The structure must comply with all safety directions, including fire safety requirements and site restrictions.
  • Guests are responsible for ensuring the structure is securely installed and does not pose a hazard to others.
  • Guests accept full responsibility for any damage, injury or risk arising from the use of the structure.
  • Legacy WA reserves the right to require the removal of any unauthorised or unsafe structure at any time.

14. Variation of Terms

Legacy WA reserves the right to amend or update these Terms & Conditions to reflect legislative changes, improve safety standards, or address operational requirements.

The current published version applies at the time of booking and occupancy.
